These Terms of Service (“Terms”) apply to your use of Fast Metal’s online booking and payment system (the “Service”) and your purchase of any activities, experiences, or services directly offered by Fast Metal (“we,” “us,” or “our”). By booking with us, you confirm that you’ve read and accepted these Terms.

2. Our Services

• Fast Metal operates both the website and the experiences listed on it. When you complete a booking, you're entering directly into a contract with Fast Metal for the purchase of the selected activity or service.

• We are fully responsible for the delivery, terms, and quality of all services provided through our platform. All policies, availability, and pricing are established and maintained by us, and we aim to ensure that all information is accurate and up to date.

3. Booking & Payment

• Booking Confirmation: Once you place an order through our website, you’ll receive a confirmation email with your reservation details.

• Payment: All payments are processed securely through licensed payment providers. You authorize us to charge your selected payment method at the time of booking.

• Fees: The final amount shown during checkout includes any applicable booking fees and taxes.

• Refund Policy: Booking and activity fees are non-refundable. If a refund is issued for any reason, it is at the sole discretion of Fast Metal.

• Cancellations: Booking cancellations are not entitled to a refund. Any refund issued is at the sole discretion of Fast Metal. Booking changes may be allowed but are not guaranteed and are subject to availability.

4. Age & Eligibility

• Minimum age for range access is 12 years old. Anyone under 18 must be accompanied by a parent of guardian. The parent or guardian assume responsibility and all liability and responsibility for the minor congruent with our general liability policies. This includes signing and agreeing to all policies terms and conditions on behalf of the minor.

• You must be at least 18 years old to book a service.

• By booking, you confirm that you have the legal capacity to enter into a contract.

• If you book on behalf of another person, you are responsible for ensuring they comply with all applicable terms and safety guidelines.

5. Accuracy & Availability

While we strive to provide up-to-date and accurate information on our site, technical or typographical errors may occur. We reserve the right to correct or cancel any booking affected by inaccurate pricing, scheduling, or other listing details.

6. Acceptable Use of Our Site

• You agree not to:

• Use bots, scrapers, or other automated tools to access our site

• Interfere with the website’s operation or security

• Circumvent payment or booking processes

• Engage in fraudulent, harmful, or abusive behavior through the site

• We may restrict access to the site at any time for violations of these terms.

7. Intellectual Property

All content on our website—including text, images, logos, videos, and design—is owned or licensed by Fast Metal and protected under intellectual property laws. You may not copy, reuse, or distribute our content for commercial purposes without our written permission.

Our site may include links to third-party websites for convenience. Fast Metal does not control or endorse these sites and is not responsible for their content, privacy practices, or security.

9. Privacy & Data Use

• We collect and process your personal information (such as your name, contact info, and transaction details) solely to complete your booking and provide the requested services.

• Sharing: We may share your data with trusted service providers (e.g., payment processors) as necessary to operate our business.

• Storage: We retain data as long as needed for legal, operational, or contractual reasons.

• Rights: You may access, correct, or request deletion of your data at any time.

10. Limitation of Liability

• Property or Equipment Damage: We are not responsible for damage to your devices or equipment resulting from the use of our website.

• Service Limitations: Our services are provided “as is” and may be unavailable due to maintenance, internet outages, or other factors beyond our control.

• Maximum Liability: Our total liability is limited to the greater of the amount you paid for the booking or $100 USD.

11. Miscellaneous

• Entire Agreement: These Terms, along with our Privacy Policy, represent the full agreement between you and Fast Metal.

• Modifications: We reserve the right to update these Terms at any time. Continued use of our website indicates acceptance of the updated terms.

12. Restrictions and Policies

Agreement to Credit Card Policy

By booking a service through Fast Metal, you agree to bring the physical credit card (or gift card) used for the purchase, along with a matching valid photo ID. Digital credit cards or digital gift cards are not accepted. If you're unable to meet this requirement, you must contact us prior to booking.

Agreement to Age Restrictions

The minimum age to participate in shooting activities is 12 years old. Guests under the age of 18 must be accompanied by a parent or legal guardian. Firearm selection may be limited for minors depending on age and safety considerations.

Drug & Alcohol Policy

For safety and in accordance with federal regulations, no guests may participate in Fast Metal activities while under the influence of alcohol or drugs (including cannabis). Any individual suspected of being impaired will be refused service and may be asked to leave the premises without a refund.

PLEASE READ CAREFULLY BEFORE PURCHASING A MEMBERSHIP

By purchasing a membership with Fast Metal Shooting Range ("Fast Metal"), you ("Member") agree to the following Terms and Conditions, which form a binding legal agreement between you and Fast Metal.

1. Membership Term and Commitment

• All memberships require a minimum commitment of 12 months, billed annually at the time of purchase.

• Your membership will remain active for a full 12-month period from the date of purchase.

• Memberships do not automatically renew. Renewal must be initiated manually by the member.

2. Annual Billing

• Membership fees are billed once per year, in full, at the beginning of the membership term.

• You will not be charged again unless you choose to manually renew for another term.

• You are responsible for tracking your renewal date and submitting payment should you wish to continue after your membership expires.

3. Credit Card Requirement

• A valid credit card is required to process your initial membership payment.

• Your credit card information will not be used for automatic renewal unless explicitly authorized during a future renewal process.

• Failed payments may be subject to service fees, and your membership will not become active until full payment is received.

4. Membership Renewal

• You must manually renew your membership before the expiration date if you wish to continue uninterrupted access.

• Renewal must be completed by submitting a new payment, either online or in person, through approved Fast Metal channels.

• Fast Metal is not responsible for notifying you of your upcoming expiration, though reminders may be sent as a courtesy.

5. Cancellation Policy

• Memberships cannot be canceled during the 12-month term, except under specific conditions outlined in Section 6.

• Failure to use the range or facility does not constitute a valid reason for cancellation or refund.

• Canceling your credit card or disputing charges does not relieve you of your financial commitment.

6. Early Termination & Military Exceptions

• Active Duty Military personnel may terminate without penalty if they are being deployed. Official deployment orders must be submitted via email.

• All early termination requests should be directed to: contact@fastmetalrange.com.

7. Suspension or Termination by Fast Metal

• Fast Metal reserves the right to suspend or terminate memberships for violations of range rules, unsafe behavior, or other policy breaches.

• Terminated memberships are non-refundable and may result in loss of remaining time and benefits.

• If you fail to show up to 3 reservations without notice, then your membership status will be revoked.

8. Range Rules and Conduct

• As a member, you agree to comply with:

• All posted and published range safety rules

• Firearms and ammunition policies

• Facility code of conduct and safety standards

• Violations may result in immediate suspension or termination without refund.

9. Default and Collections

• Fast Metal reserves the right to pursue payment through collection agencies or legal action in [County Name] Small Claims Court.

• Any additional costs, including attorney fees or court costs, incurred in the collection of unpaid balances, will be the responsibility of the member.

10. Refund Policy

• All membership fees are non-refundable, regardless of usage, early termination, or facility access changes.

• No credits or prorated refunds will be issued for partial usage of the membership term.

11. Acknowledgment and Agreement

• By purchasing a membership, you acknowledge and confirm that:

• You have read, understood, and agree to these Terms and Conditions;

• You understand that this is a 12-month, non-cancelable commitment;

• You accept that manual renewal is required if you wish to continue after the membership period ends.

Eligibility Requirements

• You must be at least 18 years of age with valid, government-issued photo identification.

• If this is your first time renting at Fast Metal and you do not possess your own firearms to shoot at time of rental you must be accompanied by another individual.

• You must not be under the influence of drugs or alcohol. Any individual suspected of such will be denied access to the range.

• You must not have been adjudicated as mentally defective, committed to a mental institution, or have a history of mental illness.

• You must not be an unlawful user of or addicted to any controlled substance, including marijuana, narcotics, depressants, or stimulants.

• You must not have been convicted of a crime or misdemeanor that would prohibit you from legally possessing a firearm.

Experience & Safety

• All renters must confirm they have read and understand the range safety rules and agree to handle all firearms in a safe and responsible manner.

• Renters should have a basic understanding of firearms and/or disclose their experience level to a range officer if uncertain.

• First-time shooters or novices may be required to take a basic safety orientation before being allowed to shoot.

Ammunition Policy

• All ammunition used in rental firearms must be purchased from Fast Metal at the time of rental.

• Outside ammunition is not allowed in rental firearms under any circumstances.

Liability & Responsibility

• You agree to release Fast Metal and its employees from any liability for personal injury or property damage resulting from the use of the firearms or facilities.

• You agree to hold harmless and indemnify Fast Metal against any and all claims arising from your actions while on the premises.

• You accept full financial responsibility for any willful misuse or damage caused to firearms, rental equipment, or range facilities, beyond normal wear and tear.

Range Use Conditions

• This policy applies whether you are using your own firearm or a rental.

• You may be denied access or rental privileges at the sole discretion of Fast Metal if you fail to comply with this policy or behave in an unsafe manner.

By signing the waiver, you affirm that you have read and understand this policy in full, and that all information you may have previously provided is true and accurate.

In exchange for being allowed to enter and use the facilities at Fast Metal, LLC (“Fast Metal” or “we”), rent or use firearms or ammunition, observe or take part in any activity on-site, I (referred to below as “I,” “me,” or “Participant”) enter into this legally binding agreement. This agreement is enforceable under law, and by signing below, I confirm that I understand it and agree to follow all its terms.

This document applies to Fast Metal, LLC, its owners, partners, employees, contractors, affiliates, successors, legal representatives, insurers, and anyone else connected to its operations (collectively referred to as the “Releasees”).

READ CAREFULLY — BY SIGNING THIS, YOU ARE GIVING UP CERTAIN LEGAL RIGHTS

ACKNOWLEDGEMENT AND ASSUMPTION OF RISK

At Fast Metal, we believe in pushing limits — but not at the expense of safety. Firearms are powerful tools, and using them comes with unavoidable risks. No matter how many rules we enforce or safety features we install, injuries can happen.

By entering our facility, I acknowledge and accept the risks involved, which may include (but are not limited to):

• Being struck by a stray round or hot brass

• Injury from ricochets, dropped weapons, or equipment failure

• Exposure to loud noise or lead particles

• Slips, trips, and falls

• Emotional distress or mental strain

• Property damage or theft

I understand these dangers and I’m choosing to participate anyway — voluntarily and fully informed. I accept full responsibility for anything that happens to me, including serious injury, illness, or even death.

WAIVER AND RELEASE OF LIABILITY

I agree that I will not sue or bring any legal claim against Fast Metal LLC or its affiliates for anything that happens during my time at the range — even if it's caused by their ordinary negligence or failure to maintain equipment.

This includes but is not limited to:

• Personal injury

• Wrongful death

• Property damage

• Emotional trauma

• Negligent design, operation, or supervision of the facilities

I’m giving up my right to bring any legal action whatsoever for incidents that happen at Fast Metal LLC, whether I'm shooting, renting gear, watching, or just walking through.

INDEMNIFICATION

If I do something that causes Fast Metal to get sued, I agree to take full responsibility. That means I will cover all legal costs, including attorneys’ fees, court costs, and investigative expenses, even if the claim is entirely about my actions or something I brought with me. I will protect and defend Fast Metal LLC to the fullest extent allowed by law.

DAMAGES

If I cause damage — whether to range equipment, rental gear, walls, doors, lights, benches, or even someone else's stuff — I agree to pay for it in full. This includes accidental, negligent, or intentional damage. If Fast Metal LLC has to take legal action to collect money for repairs, I’ll also pay all associated legal fees and collection costs.

FIREARM SAFETY RULES

I confirm that I am legally allowed to own and use firearms and that I’ve received proper safety training. I’ve read and understand Fast Metal’s Range Rules and will follow them at all times.

If I feel unsure or unsafe with a firearm, I’ll ask a Fast Metal Range Officer for help immediately.

I confirm that:

• I’m not under the influence of alcohol, drugs, or any medication that impairs judgment

• I do not intend to harm myself or others

• I will act responsibly and with complete control while on the premises

AMMUNITION RULES

For rental firearms, I understand that only ammo purchased from Fast Metal during this visit may be used. If I bring my own ammunition for use with my personal firearm, I accept full responsibility and do allow Fast Metal LLC to inspect and possibly exclude some personal ammo from the range. Certain ammunition is restricted from use on our range, these are Armor piercing, steel core, tracer, incendiary, buckshot, birdshot. I understand that using reloaded or non-standard ammo may be dangerous.

This agreement is governed by the laws of the state where the Fast Metal facility is located. If any part of it is found unenforceable, the rest still stands. This agreement applies to any future visits I make to Fast Metal unless explicitly stated otherwise in writing.
